Terms of Use

The free software components that are available for download on this site may be used in any commercial or non-commercial product without restriction, except that you may NOT sell the source code. Whether you offer the source code to your end-users is up to you; but if you do make the source code available, you are NOT allowed to sell it. There are no restrictions when a free software component is compiled into a binary executable, and you sell or deliver only the binary executable to your end users.

The licensed software components that are available for licensing on this site are the intellectual property of Hans Dietrich Software. When you buy a license for a component, you are bound by terms of the End User License Agreement (see below).

End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you, a developer of software applications, ("Developer End User") and Hans Dietrich Software ("HDS") for all HDS products, controls, source code ("SOURCE CODE"), demos, help files, and online or electronic documentation ("SOFTWARE COMPONENT(S)") which you purchase a license for.

HDS grants to you as an individual, a personal, nonexclusive license to install and use the SOFTWARE COMPONENT for the sole purposes of designing, developing, testing, and deploying application programs which you create. By installing, copying, or otherwise using the SOFTWARE COMPONENTS, you agree to be bound by the terms of this EULA.

All SOFTWARE COMPONENTS are licensed, not sold. If you are an individual, you must acquire an individual license for the SOFTWARE COMPONENT from HDS. If you are an entity, you must acquire an individual license for each Developer End User within your organization from HDS.

GRANT OF LICENSE

This EULA, if legally executed as defined herein, licenses and so grants the single individual Developer End User the following rights:
  1. SOFTWARE COMPONENT - Developer End User may install and use the SOFTWARE COMPONENT on a single computer. Developer End User may also install and use the SOFTWARE COMPONENT on a single portable (laptop) computer.
  2. ILLEGAL DISSEMINATION - You agree to take all reasonable, legal and appropriate measures to prohibit the illegal dissemination of the SOFTWARE COMPONENT or any constituent parts and redistributables to the fullest extent of all applicable local, US Codes and International Laws and Treaties regarding anti-circumvention, including but not limited to, the Geneva and Berne World Intellectual Property Organization (WIPO) Diplomatic Conferences.
  3. SEPARATION OF COMPONENTS - The SOFTWARE COMPONENT is licensed as a single PRODUCT. The SOFTWARE COMPONENT and its constituent parts and any provided redistributables may not be separated for use on more than one computer, nor placed for distribution, sale, or resale as individual creations by Developer End User. The provision of SOURCE CODE does not constitute transfer of any legal rights to such code, and resale or distribution of all or any portion of all SOURCE CODE and intellectual property will be prosecuted to the fullest extent of all applicable local, federal and international laws. All HDS libraries, SOURCE CODE, redistributables and other files remain HDS's exclusive property. You may NOT distribute any files, except those that HDS has expressly designated as Redistributable.
  4. RENTAL - You may NOT rent, lease, sublicense, or lend the SOFTWARE COMPONENT.
  5. TRANSFER - You may NOT permanently or temporarily transfer ANY of your rights under this EULA to any individual or entity without prior written approval from HDS. Regardless of any modifications which you make and regardless of how you might compile, link, and/or package your programs, under no circumstances may the libraries, Redistributables, and/or other files of the SOFTWARE COMPONENT (including any portions thereof) be used for developing programs by anyone other than you. Only you as the licensed Developer End User have the right to use the libraries, redistributables, or other files of the SOFTWARE COMPONENT (or any portions thereof) for developing programs created with the SOFTWARE COMPONENT. In particular, you may NOT share copies of the Redistributables with other co-developers. You may NOT reproduce or distribute any HDS documentation without HDS's explicit permission.
  6. ROYALTY FREE REDISTRIBUTION - The SOFTWARE COMPONENT may include certain files ("Redistributables") intended for distribution by you to the users of software applications which you create. Redistributables include, for example, those files identified in help files or on-line documentation as redistributable files. In all circumstances, the Redistributables for the SOFTWARE COMPONENT are only those files specifically designated as such by HDS.
  7. REDISTRIBUTION OF SOURCE CODE - You may NOT distribute, disclose, make available or accessible to any third party any part of the SOURCE CODE or derivative work in source code format. You may NOT use the SOURCE CODE as a basis for creating products that provide the same, or substantially the same, functionality as the SOFTWARE COMPONENT.

    You may redistribute

    1. .EXE and .DLL files compiled from the SOURCE CODE
    2. Files with the following extension names: "xml", "avi", "bmp", "gif", "ico", "jpg", "png", and "skin"

    Subject to all of the terms and conditions in this EULA, you may reproduce and distribute copies of the Redistributables, provided that such copies are made from the original copy of the Redistributables included with the SOFTWARE COMPONENT or modified versions of the Redistributables which are provided to you by HDS or those which you create. Copies of Redistributables may only be distributed with and for the sole purpose of executing application programs permitted under this EULA that you have created using the SOFTWARE COMPONENT.
